In addition to his private practice, Mr. Greenstone has served as Chairman of the Committee on conservation and Research for the New Jersey Audubon Society since 1992. In that capacity, he has assisted in the development of society positions and political strategy on many environmental issues, and has provided legal guidance for society litigation involving endangered species, clean water, land use and environmental regulation. He is former Chairman and currently serves as a member of the Board of Directors of the New Jersey Audubon Society.
Experience Selected cases:
New Jersey Department of Environmental Protection v. Exxon Mobil Corporation, 393 N.J.Super. 388 (App. Div. 2007). Established in a landmark environmental case that the State of New Jersey is entitled to recover compensation under the Spill Compensation and Control Act for the loss of use and ecological services from natural resources damaged or destroyed by a polluter. Allen v. United States Radium Corporation, Dkt. No. L-13851-84, superior Court of New Jersey, Law Division - Essex County Served as lead counsel representing some 300 residents of Essex County, exposed to radioactive materials disposed of between 1917 and 1926 at dump sites upon which their homes were subsequently built. Case settled for $4.6 million. Since there were no living witnesses to the disposal operations, plaintiffs had to rely upon forensic evidence to establish that the contamination was man-made, and was consistent with the manufacturing operations employed by USR. A database was developed from thousands of pages of EPA and engineering to relate above ground radiation levels, indoor radon and gamma radiation readings and core samples with each particular residence. By combining this database with the field work of geologists, plaintiffs developed a model of contamination to infer the presence of contamination on all properties. A health physicist then modeled individual exposure from the data that reflected the lifestyles of residents with the levels of contamination.
