New Jersey Brachial Plexus Injury Lawyers

Childbirth Arm, Shoulder and Nerve Injuries

The brachial plexus is a network of nerves stretching from the spinal cord to the shoulder, arm and hand. When trauma to the brachial plexus occurs during childbirth, it can leave the arm without function. If you suspect that your child may have experienced an injury during childbirth, seek medical attention and legal advice as soon as possible. You may be entitled to compensation if negligence was involved.

Nagel Rice, LLP, obtained $400,000 in a medical malpractice case involving a mishandled delivery resulting in shoulder dystocia. Click here to review more medical malpractice verdicts and settlements.

Medical Malpractice During Birth

Brachial plexus injuries typically occur during birth when the baby's shoulder is over-stretched while passing through the birth canal. Often, difficult births are foreseeable and preventable. If your child is suffering from Erb's palsy, shoulder dystocia or any form of brachial plexus injury, your doctor's negligence may have contributed to your child's condition.

Complications are typically the result of an obstetrician's action or inaction, such as failing to perform a C-section based on a baby's large size, and excessive use of pressure on the baby's head, neck, or shoulder. Brachial plexus injuries can cause the following symptoms:

  • Paralyzed arm
  • Lack of muscle control in the arm, hand, or wrist
  • Lack of feeling or sensation in the arm or hand
